1. Introduction 

Welcome to the Favor App! These Terms and Conditions form a legal agreement between you and Favor (the “Company”) governing your use of our services through the Favor mobile application. By creating an account and using Favor, you agree to be bound by these terms. 

2. User Accounts 

Registration Requirements: To use Favor, you must provide accurate, current, and complete information upon registration. This ensures that user profiles are reliable and maintains the integrity of the platform, crucial for transaction handling, service delivery, and communication. 

Account Security: You are responsible for maintaining the confidentiality of your account details, including passwords. You are accountable for all activities that occur under your account. Notify the company immediately if you suspect any unauthorized use of your account. 

3. Services Offered 

Marketplace Facilitation: Favor acts as a facilitator in the marketplace, connecting Favor Requesters and Favor Providers. By stating this, Favor clarifies that it acts as a platform provider rather than a direct provider or requester of services. This distinction is important for legal reasons as it impacts the company’s liabilities and responsibilities. 

Transaction Management: The app enables users to manage their service transactions, which may include posting services, bidding on requests, or making payments. This functionality is key to understanding the operational framework of Favor. 

4. User Conduct 

Legal Compliance: You must adhere to all applicable laws and regulations in your use of Favor. This ensures that interactions and transactions on the platform are lawful, protecting both users and the company. 

Prohibited Activities: Engaging in fraudulent, abusive, or illegal activities is strictly prohibited. This safeguards the integrity and safety of the platform and serves as a basis for the company to take action, including suspension or termination of accounts. It also serves as a legal basis for the company to take action against users who violate these terms.

5. Payments and Financial Terms 

Fees and Payments: Favor charges a service fee of 15% on each transaction. Payment processing services are provided by Stripe and subject to the Stripe Terms of Service. 

Cancellations and Refunds: Favor has specific rules regarding cancellations and refunds, including penalties for frequent cancellations by Providers. Users can cancel a booked service through the Favor app. To receive a full refund, cancellations must be made at least 24 hours before the scheduled time of the service. Cancellations made less than 24 hours before the scheduled service time will incur a cancellation fee of 50% of the booked service cost, which compensates the provider for their time and loss of potential earnings. 

Provider Cancellations 

If a Favor Provider cancels a booking without a valid reason or fails to show up, the Favor Requester will receive a full refund. The provider will be flagged for unprofessional conduct. Penalties for Frequent Cancellations: If a provider cancels bookings on five separate occasions without valid reasons, their account will be automatically flagged for review. Accumulation of such flags may lead to temporary suspension or permanent deactivation of the provider’s account. 

During the suspension period, the provider’s ability to accept new requests and withdraw funds will be disabled. If the account is permanently deactivated, the provider may appeal for a review. If the appeal is unsuccessful, any pending balances will be returned to the provider within 21 working days, provided the provider contacts customer support via email to request the release of funds. 

Requester Cancellations 

Favor Requesters who frequently cancel bookings may also face penalties. If a requester cancels more than three bookings within a month, they will receive a warning. Further cancellations may lead to temporary restrictions on their account, such as limiting their ability to make new bookings. 

Refunds for Service Non-Compliance 

If the service provided does not meet the agreed-upon standards or descriptions, the requester may file a complaint via the Favor app within 24 hours of the service completion. The complaint will be reviewed, and if justified, a partial or full refund may be issued. 

Dispute Resolution 

In cases of disputes between users regarding cancellations or refunds, Favor encourages parties to resolve the issue amicably. However, if resolution cannot be achieved, users can escalate the matter to Favor’s support team, which will mediate and help find a resolution based on the policies stated.

Processing of Refunds 

Refunds, when approved, will be processed within 5-10 business days and credited back to the original mode of payment used during the transaction. Note that the processing time can vary depending on the payment service provider. 

6. Limitation of Liability 

Scope of Responsibility: Favor acts solely as a marketplace platform that connects Favor Requesters and Favor Providers to facilitate the offering and requesting of services. As such, Favor is not responsible for the actions or omissions of any user on the platform. 

Non-endorsement: While we facilitate a marketplace for services, we do not endorse any user. All transactions and interactions made through the app are the sole responsibility of the participating individuals. Favor disclaims all liability associated with these interactions. 

Mishaps During Service: Favor is not responsible for any mishaps, injuries, damages, or losses that occur during the performance of any service arranged through the platform. The responsibility for ensuring the safety, legality, and quality of the services provided rests entirely with the users who engage in such transactions. 

User Discretion Advised: Users are advised to exercise discretion and due diligence when choosing to engage with other users on the platform. Favor recommends that users consider using features provided on the platform, such as reviews and verification, to make informed decisions. 

7. Cooperation with Law Enforcement 

This policy outlines Favor’s commitment to legal compliance, specifically in terms of cooperating with law enforcement. By including this clause, Favor informs users that their information can be disclosed to authorities without prior notice if required by law. This serves as a deterrent against using the platform for illegal activities and ensures that Favor can operate within legal boundaries without incurring liability for obstructing justice. 

8. Intellectual Property 

Rights Ownership: This section asserts that all intellectual property related to the Favor app and its content belongs to the company or its licensors. This includes, but is not limited to, software, graphic designs, and user interface elements. 

Usage Restrictions: By stating that users cannot use any content without prior written permission, Favor protects its intellectual assets from unauthorized use, which is vital for maintaining the unique value of the platform and its services.

9. Termination and Suspension 

All intellectual property rights in the Favor app and its content are owned by the Company or its licensors. You may not use any content from our app without prior written permission. 

10. Amendments to Terms 

This provision allows Favor to modify the terms and conditions as necessary. This flexibility is crucial for adapting to new legal requirements, technological changes, or business needs. Users are informed of changes through updates on the app, which is a standard practice for ensuring that users are always aware of the terms that govern their use of the service. 

11. Governing Law 

These terms are governed by the laws of Maryland, USA, where the company is based. This jurisdiction governs any disputes arising from the use of the app.
